WHIMZY® is a federally registered trademark of Whimzy LLC, registered with the United States Patent and Trademark Office in International Class 35. All rights reserved.

Unauthorized use of the WHIMZY® mark — including without limitation in domain names, social media handles or usernames, keyword or search advertising, metadata, or on or in connection with competing goods or services — is strictly prohibited and will be enforced to the fullest extent of the law, including under 15 U.S.C. § 1114 and § 1125 (Lanham Act) and analogous foreign law.

Nothing on the Store, and no purchase of any product, grants any license or right to use the WHIMZY® mark, the Whimzy trade dress, or any Company logo or brand asset.

All content on the Store — including all artwork, designs, slogans (including "Get That AI Money"), graphics, product photography, text, page layouts, and the selection and arrangement thereof — is owned by Whimzy LLC or its licensors and protected by United States and international copyright law. Purchase of a physical product conveys ownership of the physical article only, not of any underlying design or artwork. Digital products are licensed, not sold, per Section 6 of the Terms of Service.

Copyright / DMCA notices: Notifications of claimed infringement under 17 U.S.C. § 512 may be sent to the designated contact in Section 1 above, with "DMCA Notice" in the subject line. Notices must include the elements required by 17 U.S.C. § 512(c)(3).

6.1. Informational content. Content on the Store is provided for general information and entertainment. Product descriptions and imagery are provided in good faith; minor variations inherent to on-demand production are described in Section 9.2 of the Terms of Service.

6.2. Third-party platforms and links. The Store is hosted on Shopify Inc. Any links to third-party sites are provided for convenience; we do not control and are not responsible for their content or practices.

6.3. No professional advice. Nothing on the Store constitutes legal, financial, or investment advice, notwithstanding any slogan, design, or motif referencing money, markets, or wealth.

The European Commission's Online Dispute Resolution (ODR) platform was discontinued in July 2025 and is no longer available. EU consumers retain all rights described in Section 15 of the Terms of Service, including the right to bring proceedings before the courts of their country of habitual residence.

German residents: we are neither willing nor obliged to participate in dispute-settlement proceedings before a consumer arbitration board within the meaning of § 36 VSBG, except where required by law.

VAT (EU imports): For consignments to the EU not exceeding EUR 150, VAT is collected at checkout under the Import One-Stop Shop (IOSS) scheme where we are registered. IOSS number available to customs authorities upon lawful request.

US sales tax: Collected at checkout where required by applicable state law and remitted through our commerce platform.
